All services provided by Rezuru (Rezuru) may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any United States federal, state or city law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Rezuru from any claims resulting from the use of service which damages the subscriber or any other party. Prohibited are sites that promote any illegal activity or present content that may be damaging to Rezuru servers, or any other server on the Internet.  Links to such materials are also prohibited.

Server Abuse

Any attempt to undermine or cause harm to a server or customer of Rezuru is strictly prohibited. As our customer you are responsible for all your accounts. Should you violate the Terms of Services outlined within, your account will be terminated without chance of refund or data retrieval. If requested we will provide your full name and email address to the victim. It is strictly forbidden, without prior written authorization, to allow a third party or the user of another web hosting service to use or access your account's resources. Without limitation, this applies to usage of an account to provide public online services like statistics, image hosting or any other service targeted to external web sites. Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.

Refusal of Service

We reserve the right to refuse, cancel or suspend service, at our sole discretion. All virtual private servers, game servers, sub-networks, distributive hosting sites and dedicated servers of Rezuru must adhere to the above policies, with the exception of system resources in respect to dedicated servers.

Billing By the Account Activation Date of each month, Rezuru shall either: (1) debit the clients credit card or other form of payment method (when such information has been provided by the client); or (2) deliver, by e-mail or regular mail, an invoice in accordance with the applicable Service Fees for services rendered for the current month. When an invoice is delivered to the client, payment shall be remitted to Rezuru by no later than the specified payment due date. Rezuru shall be entitled to immediately terminate this agreement for clients failure to make timely payments. You will be provided with an invoice on a monthly basis. All payment methods are billed on a monthly basis. It is the clients responsibility to ensure that they pay the invoice on time. If the client does not pay the invoice by or on the due date, the service will be suspended and ultimately terminated.

Service Fees

Certain services carry a setup fee charged by Rezuru to client, which must be paid by client in order to have use of said services. If client terminates this agreement, client shall be responsible for any and all outstanding fees owed to Rezuru and agrees to pay any and all fees incurred by client. Because the services are provided on a monthly basis, the client will be responsible for service fees incurred each month, regardless of when client provides notice of termination. Thus, for example, if the client provides notice of termination on the 15th day of a particular month, the client will be responsible for service fees for the entire month, and such fees will not be pro-rated or refunded. If a payment is charged back or disputed via the payment processor, credit card company, the user, or other entity resulting in the funds being unavailable to Rezuru, the customer is required to pay the amount charged back or disputed plus a $25.00 chargeback fee. If the customer does not pay upon Rezuru's request, we will pursue legal action against the customer and the customers information will be submitted to the MaxMind fraud database.

Money back guarantee & refund policy

We offer a 3 day money back guarantee. Refunds are available to customers at our sole discretion. Refunds are not available for dedicated servers.

Cancellation Refunds

We DO NOT refund partial monthly fees to accounts. We require 30 days notice for a cancellation.

Refunds If you decide to cancel after prepayment, you will not receive a refund for the current month in use (we do not give partial months refunds). If cancellation is done by Rezuru due to an account violation, there will be no refund. Additional features can be added at any time. Rezuru reserves the right to change prices at any time, but will notify all clients before such changes take place.

Refusal of Service

We reserve the right to refuse, cancel or suspend service, at our sole discretion.

Account Information We require all information listed on the customers account to be factual. Providing invalid or non-factual details will result in immediate account and service(s) termination without chance of restitution.

Data Loss Rezuru will not be responsible for any data loss to clients files & accounts. It is to remain the clients sole responsibility to maintain backups of their data. Refunds will not be given if data loss is occurred.

Limitation of Liability Rezuru shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Rezurus servers going off-line or being unavailable for any reason whatsoever. Furthermore, Rezuru shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site or server data from any of Rezuru servers.

Violations

Violations of these Acceptable Use Policies should be referred to administrator@rezuru.com / All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account and service(s) termination.

Disclaimer

Rezuru cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their site was functioning. Certain services provided by Rezuru are resold. Thus, certain equipment, routing, software and programming used by Rezuru are not directly owned or written by Rezuru. Moreover, Rezuru holds no responsibility for the use of our clients accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as Rezuru sees fit.

By activating your account with Rezuru, you agree to the above policies and disclaimer. These terms and/or conditions may change at any time without notice.

NOTICE: If you sign up for an account and fail to comply with these terms, no refunds will be given.  

Spam

Rezuru is committed to a strict anti-spamming policy. Under this policy, we prohibit spam, or any unsolicited commercial email, from being sent either: Over the Rezuru network, by clients or any other users of the Rezuru network (including the client's customers); AND/OR over ANY network - if the message sent advertises or mentions a site hosted on the Rezuru network. We react quickly and seriously to violations, and we further reserve the right to terminate the services of any client disregarding this policy. Dedicated server customers may have their accounts suspended without notice, depending on the severity of the incident. Sending unsolicited commercial email (a.k.a. "spam"), cross-posting messages to a large number of usenet groups, posting obscene or threatening messages while using or referring to an email address or web site URL on Rezuru network is prohibited. The use of Rezuru' network as a mail drop for responses to activities described above is also prohibited. Accounts cancelled due to spam will be billed a "clean up" fee of $100 along with a potential fee of $50 per mailing/complaint if they are deemed to be unresponsive to our requests. Server Uptime Guarantee

Rezuru guarantees 99.9% uptime on all hosting plans (with the exclusion of dedicated servers). Should we fail to deliver this for any given calendar month, your account will be credited upon request for an amount we see fit. Rezuru reserves the right to amend any or all of the above policies, guidelines and disclaimer without notification. We also retain the right to increase any pricing and make changes to our account plans without notification.
